WHYNOTT Privacy Policy

1. General Provisions

1.1 This document uses the same terminology and abbreviations as our Terms and Conditions document. This Privacy Policy governs the collection, use and storage of Information obtained from Users through the use of our Platform.

1.2 The Information on Users is divided into personally identifiable and non-personally identifiable Information depending on whether Information can identify the User as a specific person.

2. Collection and Use of Personally Identifiable Information

2.1 We require some personal information in order to provide our Services. The information we collect is necessary to provide our Services, and we do not collect any information which is not strictly required by the nature of the Service. Personal Information which we may collect includes:

(A) Phone number

2.2 We will collect your phone number in the interest of providing our Services. We will collect your phone number to create and facilitate an account for you and to send you notifications about your account such as when we need to verify your account, you forget your password, or if there is a data breach. Account is necessary to access some of our Services and if you do not provide us with your phone number for this purpose you will not be able to access these Services.

(B) Age

2.3 We will collect the information about your age in order to verify that you are eligible to use our Platform and we will convey to the Venue Administrators if you are over 18 years old when their promotions, coupons or similar include items that are subject to age restrictions. 

(C) Sex

2.4 Our App is used as a social interaction tool. Having this in mind you may choose to provide us with information about your sex, gender and sexual preferences. We will only use this information to display it on your profile. We collect this information based on your consent.

(D) Location

2.5 We will collect your location information on a basis of your consent and in the interest of providing our Services. We will only use this information to provide you with the list of users that are located near you and to display available group chats organized by Venue Administrators.

(E) Profile Information

2.6 Considering the nature of our services, you may choose to display some sensitive personal information on your profile and make that information available to other users. This information may include your photos, videos, body type, gender, relationship status or similar. You may also connect your social media profiles with the WHYNOTT account, in which case we will collect Information from your social media account in accordance with your account privacy settings. Please be careful when you choose to display such information. We will only use this information to display it on your profile, to provide you with the content that corresponds with this information and to include you on other user’s search queries.

2.7 You may choose to list other information about yourself on your profile such as your interests and your mood. We provide you with an option to search for other users with similar interests and mood who we believe might be a good match for you. When you choose this service we will process and analyze your information to provide you with the service and you understand and agree that without information about your interests and your mood we may not provide this search service to you.

(F) Phonebook and Contacts

2.8 We may access your phonebook or contact list information available on your device when you choose to use some functionalities of our Platform, such as when you want to check if anyone from your list of contacts is also a Platform user. If the requested services require access to your phonebook information, we will inform you beforehand and seek your consent. When the consent is provided, Information from your phonebook is uploaded to our servers only for the purpose of processing your request for services and is deleted immediately after your request is provided with the results, if any. We do not store, share or process this information for any other purpose. You may also choose to let other people see that you are using the Platform if they upload their contact list or phonebook containing your details. You may change this setting at any time through your user account.

(G) General

2.9 We may keep records of any questions, complaints or compliments made by you and the response if any. Whenever you contact us, we will collect your name, e-mail address and any additional information which you provide. We will store and use your name and e-mail address only for the purpose of responding to your inquiries and we will remove such Information from our servers as soon as the inquiry is resolved. Information contained within the inquiry, free from any personally identifiable Information, will be stored on our servers for the purpose of improving our Services and providing the best customer support possible.

2.10 You recognize and concur that WHYNOTT bears no obligation regarding the risk, harm, damage, or loss that might emerge from content submitted to or distributed through the Platform. You further understand that by providing your content online, other people will have access to such content and they will be able to copy, share or otherwise interact with such content. If you do not want your content to be used as described the only remedy is to not share your content. We encourage you to review your profile settings to distinguish which information is shared publicly through your profile and to be very careful about which information will you choose to share. We do not monitor nor do we prescreen private messages transferred through the Platform, and although we expressly prohibit disseminating any content which is illegal, hateful, obscene, threatening, incites violence, insulting, defamatory, infringing of intellectual property rights, invasive of privacy, or contains graphic or gratuitous violence or is otherwise objectionable to third parties, you hereby agree that you may be exposed to any such content and that you use the App and the Services at your own risk.

2.11 We do not sell, rent or lease your personal Information to third-parties. We use collected Information for our internal and marketing purposes, as necessary by the nature of the Services, and only in accordance with this Privacy Policy. We may share aggregated statistical information with the Venue Administrators for the purpose of organizing and customizing their promotions. In some instances, we are obliged to comply with court orders and government requests and provide Information or parts of it to authorized bodies.

2.12 We endeavor to maintain appropriate physical, procedural and technical security with respect to the collected information so as to prevent any loss, misuse, unauthorized access, disclosure, or modification of personal information which also applies to our disposal or destruction of personal information. We keep the personal Information we collect about you strictly confidential and only for as long as such information is necessary. We will remove and dispose of any Information we may have about the Users within twenty-four (24) hours of deleting their User account. We may also delete the contents of the group chats after twenty-four (24) of their publishing.

2.13 We acknowledge that the safety of your Information is one of the highest priorities and therefore only authorized personnel operating under strict confidentiality agreements have access to personally identifiable Information. Although we take all appropriate measures in respect to keeping your information secure, you understand that no data security measures in the world can offer 100% protection. You understand and agree that providing personal information online is always under the risk of falling into wrong hands. Even though, we will not misuse your information and we will do whatever is reasonable in current situation to prevent unauthorized access to personal data, we cannot guarantee nor can you expect that we will keep your data secure or prevent a data breach. If we ever find or suspect a personal data breach we will without delay notify the appropriate supervisory authority and Users about the breach.

2.14 Please keep in mind that by making your data visible to other users of the Platform, they will be able to see it and some may even try to misuse it. Although we prohibit such use of our Platform we cannot control user’s actions. Making your data visible to other users is at your sole risk and discretion.

3. Collection and Use of Non-Personally Identifiable Information

3.1 We may collect non identifiable analytics data through cookies or third party services. We use such information to provide and improve our Services, customize services for you, better understand our Users, diagnose and fix problems, etc. More information about cookies and similar technologies we use can be found under paragraphs 6 and 7 of this Privacy Policy.

4. Storage and transfer of Information

4.1 Information will be stored on secure servers located in Belarus. Hosted servers are controlled and maintained in accordance with sufficient privacy safeguards. We may store or transfer Information to servers located in countries outside of Belarus, provided that such countries implement appropriate and suitable safeguards regarding the security of personal information.

4.2 Information is stored on the servers only for the duration necessary for providing the Services and maintaining the integrity of our databases.

5. Information retention period

5.1 If you register an account with us we will store your Information for as long as you have an active account. As soon as you delete your account we will remove all Information we have collected about you. We may keep your information for up to 30 days in our backup in order to maintain the integrity of our backup storage data.

6. Cookies and similar technologies

6.1 Cookies help us optimize and improve the user experience of the Platform by helping us deliver crucial functionalities. The cookies we use may vary over time as we continuously update and improve our Platform.

6.2 By visiting the Platform we may use cookies to store some non-identifiable Information on your device regarding your mobile device and your activities in order to help improve the User experience. Users can deny access to cookies through their device settings.

7. Third Party Websites, Services, and Cookies

7.1 The Platform and messages may contain links to other external websites that do not fall under our domain. We are not responsible for the privacy practices or the content of such external websites. If you choose to follow such links to external websites, you do so at your risk.

7.2 We may use third party services like Firebase, Google Analytics for Firebase, Google Cloud Platform and other. Cookies from such services, Android Advertising ID, Advertising Identifier for iOS and similar technologies are used to collect data for statistical reports. 7.3 Users may opt-out of certain Firebase features — including Google Analytics for Firebase through applicable device settings, such as the device advertising settings for mobile phones or visit the Network Advertising Initiative Opt-out Page for more details https://optout.networkadvertising.org/#/

8. Changes to the Privacy Policy

8.1 We reserve the right to change our Privacy Policy at any time. The current version of Privacy Policy is available through the Platform, indicating the effective date. You are encouraged to periodically check our Privacy Policy.
